Terms of Service

These Terms govern access to and use of HireACare by families, caregivers, and other visitors.

Acceptance of these Terms

By creating an account, submitting a profile, requesting an introduction, or otherwise using HireACare, you agree to these Terms, the Privacy Policy, the Disclaimer, the Community Standards, and any additional rules displayed during use. If you do not agree, do not use the platform.

Eligibility

  • You must be at least 18 years old.
  • You must have legal capacity to enter binding agreements.
  • You may not use the platform if your account has been suspended or terminated.
  • You must use the platform only for lawful caregiver and household-service connections.

Accounts and security

You must provide accurate, current information, protect your password, and notify HireACare of suspected unauthorized access. You are responsible for activity under your account. HireACare may request verification information or suspend access while investigating safety, fraud, or policy concerns.

Role of HireACare

HireACare facilitates introductions between independent users. It does not employ, supervise, direct, control, train, schedule, or pay caregivers and is not a party to any private arrangement. Users decide independently whether and how to work together.

Family responsibilities

  • Evaluate caregivers independently and conduct appropriate interviews and checks.
  • Describe duties, household conditions, schedule, compensation, and expectations truthfully.
  • Comply with wage, overtime, payroll, tax, insurance, immigration, work-authorization, and domestic-worker laws.
  • Provide a safe, lawful, respectful working environment.
  • Never request illegal, discriminatory, exploitative, or unsafe work.

Caregiver responsibilities

  • Provide truthful profile, identity, work-history, availability, and qualification information.
  • Perform only work you are legally permitted and competent to perform.
  • Disclose material limitations relevant to the requested work.
  • Comply with applicable employment, tax, licensing, immigration, safety, and professional rules.
  • Protect family privacy and property and report unsafe or illegal requests.

Prohibited conduct

  • Fraud, impersonation, false profiles, forged documents, or misleading claims.
  • Harassment, threats, exploitation, abuse, stalking, or unlawful discrimination.
  • Requests or offers involving illegal work, unsafe conduct, trafficking, coercion, or sexual services.
  • Scraping, harvesting, publishing, or misusing private contact information.
  • Malware, unauthorized access, interference with the platform, or circumvention of security controls.
  • Using another person’s account or creating accounts to evade enforcement.

User content

You retain ownership of content you submit. You grant HireACare a nonexclusive, worldwide, royalty-free license to host, reproduce, format, display, and distribute that content as reasonably necessary to operate, secure, promote, and improve the platform. You represent that you have the right to submit the content and that it does not violate law or another person’s rights.

Moderation, suspension, and termination

HireACare may review, edit, restrict, reject, remove, preserve, or disclose content and may suspend or terminate accounts when reasonably necessary for safety, legal compliance, fraud prevention, policy enforcement, or platform integrity. HireACare is not required to publish or continue publishing any profile.

Fees and payments

Unless HireACare expressly introduces a paid service, compensation and financial arrangements are solely between families and caregivers. Future paid features may be governed by additional terms disclosed before purchase.

Disclaimers and liability

The Platform Disclaimer is incorporated into these Terms. To the fullest extent permitted by law, HireACare provides the service without warranties and limits liability for acts, omissions, statements, arrangements, and disputes involving users.

Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless HireACare and its owners, officers, employees, contractors, and affiliates from claims, losses, liabilities, costs, and expenses arising from your content, conduct, legal violations, employment or service arrangements, or breach of these Terms.

Governing law and disputes

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles, except where another law must apply. Any dispute forum, arbitration provision, class-action waiver, or venue clause should be reviewed and finalized by HireACare’s attorney before commercial launch.

Changes and contact

HireACare may update these Terms by posting a revised version and effective date. Material changes may be communicated through the platform. Questions may be sent to support@hireacare.com.
